Service Agreement
Infintel.com and infinitytelecominc.com are subsidiaries of Infinity
Telecom Inc. Here in after jointly referred to as “The Service
Provider”. By signing up as an user in the website of the Service
Provider, or using its services you hereby acknowledge and agree to be
bound by the terms and conditions set forth in this Service Agreement:
1. Definition
The terms and language used in this Agreement, if not defined in this
section shall have the general meaning in Standard English or language
commonly accepted in the telecommunication industry.
The ServiceThe Service refers to any products or services designed
and provided by the Service Provider, which are actively promoted in the
Service Provider’s website, here in after refers to ITC Services.
The Service Provider
The Service Provider refers to Infinity Telecom and all of its
subsidiaries.
The Subscribers
The Subscribers refer to personal and/or business entities that have
signed up to use ITC Services or have paid for ITC Services that they
plan to use or refers to personal and/or business entities that have
accepted the terms and conditions of this Service Agreement.
The Members
The Members refer to personal and /or business entities that have
registered in the Service Provider’s website.
Member Accounts
Member Accounts refer to accounts that are assigned by the Service
Provider at member registration or accounts that the Service Provider
generates for the members based on the personal information such as ANIs
or registered phone numbers provided by the Member at registration.
ITC Rate Table
ITC Rate tables refer to any and all rate tables that are posted in the
Service Provider’s website.
2 Service Cancellation
This agreement shall remain in full force until such time when either
party agree to terminate.. Members or Subscribers of ITC Service may
cancel the membership or subscription at any time. To cancel membership
or subscription, a notification must be sent via email to csr@infintel.com
with the ANIs or registered phone numbers along with a termination
request. Please note that to Cancel ITC Services, a member’s most
current email address must be included in the cancellation request and
it has to be matched with the Members email address on ITC’s record. The
Service Provider, may at its sole discretion, cancel, suspend, or
otherwise terminate Services at any time without prior notice for
reasons that in its judgment, may preclude it from receiving payment for
its services. Members and Subscribers agree that the Service Provider
has been given the authorization to impose a final charge if there was
an outstanding balance in a Member’s account.
3. Billing Issue
All Services usage will be billed to Member’s or subscriber’s account at
minimum of one minute and will be rounded up to the next full minute
thereafter.
4. Payment
A subscription to ITC Services requires a credit card number for credit
verification and/or payment of charges. Members and Subscribers
acknowledged that all credit card transactions in the Service Provider’s
website are processed through the secured server of a third party
professional internet payment processing company and are therefore
transparent to the Service Provider. By providing his credit card
number, a Member or Subscriber authorizes the Service Provider to submit
charges for the TIC Services he subscribed against his credit card
account and agree to hold the Service Provider harmless against any
fraudulent uses or unauthorized uses of his credit card account by any
third parties.
5. Indemnity of Liability
Members or subscribers of ITC Services agree that the Service Provider
is unable to verify the identity of persons using the Service with his
account and therefore agree to indemnify and hold harmless the Service
Provider, its share holders, officers, or employees from any and all
claims for possible damages, losses, obligations, liabilities and
expenses (including without limitation to reasonable attorneys' fees and
other costs and expenses) arising out of or related directly or
indirectly to using or subscribing to ITC Services. The Service Provider
is not responsible for lost or stolen PINS or unauthorized usage in any
Member Accounts.
6. Limitation on Warranties
The Services provided by the Service Provider is on an as it is and as
available basis. The warranties expressly set forth in this Service
Agreement constitute the only warranties related to such Services. The
Service Provider does not warrant expressly or implied that the Services
provided is fit for a particular purpose.
7. Expiration Date
All active Pinless Subscriber Accounts are valid as far as there is a
positive balance. All accounts without activities in 90 days would be
considered inactive and are subject to automatic removal. All other
accounts other than Pinless Subscriber Accounts including without
limitation to phone cards and other value added services accounts will
expire as posted in each product description. Expiration dates would be
extended for another valid period as posted in each product description
from the day a recharge is made to the account. Service Provider
reserves the right to deactivate any accounts and remove all other
features and services pertained to them if the balance of accounts
remains zero or negative for a period over30 days.
8. Availability of Service
The Service Provider makes no warranties or guarantees that all
countries, destinations, or numbers may be accessible through its Access
Numbers. For example, calls to NPA such as 700, 800, 866, 888, 877, 900,
976 or collect calls would not be terminated with any ITC Services.
9. Rate
ITC rate tables are clearly listed on the RATES PAGE of the Service
Provider’s home page http://www.infintel.com or http://www.infinitytelecominc.com
. The Service Provider will use reasonable effort to keep its rates
stable and competitive. But as international rates are determined by the
market conditions and/or other economic factors, the Service Provider
reserves the right to modify the rates listed in the Rate Table from
time to time without prior notice.
10. Procedure for Recovery of Lost or Forgotten PINs
For lost or forgotten PINs recovery, members may contact the Service
Provider’s online customer service via e-mail at csr@infintel.com. 24
hours a day, 7 days a week. A lost or forgotten PIN will be recovered
within 24 hours if sufficient information was provided in the email.
Basic information such as member’s registered phone number, email
address, phone card’s serial number, member’s address must be included
in the request. For security reasons and to protect the interest and
privacy of all Members and Subscribers, a lost or forgotten Pin will be
recovered only if all information provided matches the information
contained in member’s registration.
11. Changes to Terms and Condition
The Service Provider reserves the right to revise these Terms and
Conditions from time to time as necessary at the sole discretion of the
Service Provider. Members and subscribers have thirty days to review and
accept the new terms and conditions. If no opposition was received by
the Service Provider from the members or subscribers 30 days from the
day on which the new Agreement is post in the Service Provider’s
website, or if a member or subscriber continue logging into his account
or continue using the Service subscribed, they are deemed to be apprised
of and bound by any and all changes made to the Terms and Conditions. A
member or subscriber has the right not to accept the changes by stop
using the Services or logging into his account or cancel his membership
by sending an email to csr@infintel.com.
